SeaSight – Terms and Conditions of Sale
1. General
These Terms and Conditions apply to all sales of SeaSight products and services by Highgrove Computer Services Limited, trading as SeaSight (“we”, “our”, “us”). By purchasing or subscribing, you agree to these Terms. Your statutory rights under UK law, including the Consumer Rights Act 2015, remain unaffected.
2. Product Purpose and Use
SeaSight products are designed to deter theft and assist in potential recovery. They do not prevent theft, damage, or loss. Effectiveness depends on installation quality, signal coverage, power supply, and environmental conditions. Users are responsible for correct fitting, maintenance, and ensuring any alerts or notifications are appropriately monitored.
3. Prices and Payment
All prices are shown in pounds sterling (GBP) and are subject to VAT where applicable. Payment must be made in full before dispatch or activation of any related service or subscription.
4. Subscriptions and Network Services
Some SeaSight products require a data, network, or application subscription for full functionality. Subscriptions are provided for the period stated at purchase. Access to any application, server, or network services will automatically cease if payment is not renewed upon expiry of the initial or subsequent subscription period. We may modify or withdraw online or network features with reasonable notice, where required by technology, coverage, or supplier changes.
5. Delivery
Delivery dates are estimates only. We are not liable for delays caused by carriers, customs, or events beyond our control.
6. Returns and Faulty Goods
If your product is faulty, contact us within 14 days of receipt. We will repair, replace, or refund it in accordance with the Consumer Rights Act 2015. Returns for non-faulty goods are accepted only at our discretion and must be unused and in original packaging.
7. Firmware, Software, and Updates
SeaSight devices may receive firmware or software updates to maintain performance, security, or compatibility. These may occur automatically. We are not liable for temporary interruptions during such updates.
8. Limitation of Liability
To the fullest extent permitted by law: Our total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the original purchase price of the product concerned. We are not liable for indirect, consequential, or incidental losses, including but not limited to loss of data, signal, profit, or use. SeaSight devices are not a substitute for appropriate mooring, insurance, or physical security.
9. Ownership and Risk
Ownership transfers to you upon full payment. Risk passes to you upon delivery.
10. Governing Law
These Terms are governed by the laws of England and Wales, and any dispute shall be subject to the exclusive jurisdiction of its courts.
